Photography Terms of Service
By booking a photography session, the Client agrees to the following terms:
Services & Payment
The Photographer will provide photography services as described at the time of booking. Payment is due according to the terms provided with the booking or invoice. A session is not confirmed until any required payment or retainer has been received.
Cancellation & Rescheduling
The Client may request to reschedule due to illness, weather, or other reasonable circumstances. The Photographer may reschedule when conditions could affect the safety or quality of the session. Payments and retainers may be transferred to a rescheduled session but are otherwise non-refundable unless agreed upon by the Photographer.
Image Selection & Delivery
The Photographer will select and edit images consistent with their professional judgment and artistic style. When a proofing gallery is provided, the Client may be asked to select images for final editing and delivery.
The number of images, delivery method, and estimated turnaround time will be provided as part of the booked session.
RAW, unedited, rejected, or duplicate images are not included in the final delivery.
Copyright & Client Usage
The Photographer retains all copyrights to photographs created during the session.
The Client receives a perpetual, non-exclusive, royalty-free license to download, print, reproduce, share, and display delivered photographs for personal, non-commercial use. This includes sharing with family and friends, posting to personal social media accounts, and printing through a service of the Client's choice.
Photographs may not be sold, licensed, commercially reproduced, or used for commercial purposes without the Photographer's written permission. Delivery of digital files does not constitute a transfer of copyright.
Model Release
The Client grants the Photographer permission to use photographs created during the session for the Photographer's professional portfolio and self-promotional purposes, including website, social media, printed materials, studio samples, advertising, photography competitions, and publications featuring or promoting the Photographer's work.
The Photographer will not sell or license identifiable photographs of the Client to an unrelated third party for commercial use without additional permission.
If the person photographed is under 18, the signing parent or legal guardian represents that they have authority to grant this permission on the minor's behalf.
Artistic Discretion
The Client acknowledges that photography and editing reflect the Photographer's individual artistic style and grants the Photographer discretion regarding composition, image selection, cropping, color treatment, retouching, and other creative decisions.
Liability & Image Storage
The Photographer will take reasonable precautions to protect photographs and equipment. In the unlikely event that images are lost, damaged, or otherwise undeliverable due to equipment failure, data loss, or circumstances beyond the Photographer's reasonable control, the Photographer's liability will not exceed the amount paid for the affected session.
The Photographer is not required to retain photographs or online galleries indefinitely. Clients are responsible for downloading and securely backing up their delivered photographs.
Agreement
By booking a session and electronically accepting these Terms of Service, the Client acknowledges that they have read, understood, and agreed to these terms.
